VACATION RENTAL TERMS AND CONDITIONS - INCLUDING FULFILLMENT CONDITIONS

RESERVATION POLICIES

Payment Policy: 50 % deposit is required at the time of booking to reserve the property, with the balance is due 30 days prior to arrival. If the reservation is made less than 30 days before arrival then payment in full will be necessary. The name of the person booking the reservation, the name on the credit card, and the name of the person who agrees to this rental agreement must all match.

All payments must come from the person named on the reservation. We will return any payments (minus the bank fees) received from an account that does not match the reservation name. Bank fees are 3% when our bank takes the unacceptable payment, plus another 3% to return the unacceptable payment.

CHECK-IN

Check-in time begins at 4:00pm on. The Abide Property Management will make every attempt to have the property ready for check-in on time. We can’t guarantee this time, however, as there are situations that may occur beyond our control.

Guest, agrees to assume responsibility for notifying Abide Property Management immediately upon check-in if the Property is found to be in less than good condition or if any damage (other than normal wear and tear) is noted. Failure to notify Abide Property Management of any damage or issues within 24 hours of check-in serves as acceptance of the condition of the Property and its contents as satisfactory.

You will be sent a message on the day of check-in approximately seven hours before check-in in which will give you the door code needed to enter the property.

CHECK-OUT

Check-out time is 10:00 am on your check-out and departure date.

Note: Door Code will expire automatically at 10:00 am on your check-out day.

To avoid additional charges, please abide by our check-out time and procedures. Our cleaners have limited time to prepare the property for the next guests. If a Guest stays past the check-out time and interferes with cleaners coming to prepare for the next guests, the Guest will be billed for an entire additional day.

CHECK-OUT PROCEDURES

Before check-out the following items will need to be done:

- Start the dishwasher with the remainder of your dirty dishes.

- Take out the kitchen trash and place it in the trash can outside the home to prevent odors.

- Leave the beds unmade.

- Turn off all interior and exterior lights and ceiling fans.

- Close and lock all doors.

- Report any damages to the home or its contents that occurred during your stay.

If the Property is not left in good condition, excessive cleaning charges will may apply and the Guest will be charged at our cleaners hourly rate of $50/hr.

TRAVEL INSURANCE

To protect your vacation investment, we strongly recommend you purchase travel insurance. Reservation refunds will not be given due to weather, illness, or other circumstances beyond our control.

CANCELLATION AND REFUND POLICIES

If a cancellation is made more than 10 days before the arrival date, there will be a cancellation fee of $100.00 USD. At that time we will issue you a credit card refund of your reservation less than $100.00 USD cancellation fee which will show on your account between 5 to 6 business days.

If cancellation is made 9 or fewer days before the arrival date, there will be no refunds.

No refunds for canceled holiday date reservations.

Please note: There are no refunds for early departures.

- Abide Property Management cannot accept cancellation requests with less than the required cancellation advance notice.

- Abide Property Management reserves the right to rent the unit to a different group if the reservation is not paid in full by the payment due date.

- Cancellations occurring due to lack of total payment will result in forfeiture of the initial payment plus any rent, taxes, and fees paid.

- Guest understands this property is privately owned and furnished per the owner's requirements and preferences. It is understood and agreed that discounts and refunds will not be given because of differences in the guest, or other members of the guest's party's tastes or preferences with regard to furnishings, beds and pillows, appliances, decor, or amenities.

- Guest understands that no refunds or discounts will be provided due to events outside of Abide Property Management control such as weather, and marine life warnings, etc.

- There will be no refunds for mechanical failure of appliances, a/c units, etc., but if a problem arises during your stay, please let Abide Property Management know promptly via the booking platform messaging and every effort will be made to promptly to fix the issue.

- The property is professionally treated for bugs and pests a minimum of 4 times a year. Due to the fact the home is located in a natural environment, Abide Property Management cannot guarantee that bugs or pests won't occasionally get into the home. There will be no refunds or discounts if a bug or pest is found in the home. If you see a bug or pest please let Abide Property Management know promptly via the booking platform messaging. Abide Property Management can arrange an additional pest control treatment during the Guest's stay if desired.

- The reservation and acceptance of this agreement binds the Guest to the Property. There should be no expectation of refunds or relocation because you are disappointed with the property you have rented or if something associated with the property is not working to your satisfaction. Please closely review the property listing to ensure it will suit the needs of you and your party before booking.

GROUPS POLICY

The Property is being rented for family vacations only. Abide Property Management gladly rents to families or responsible adults over the age of 26.

Abide Property Management has a No-Group Policy, which includes, but is not limited to the following: school (including college) groups, spring break groups, prom, graduation, etc. Abide Property Management MAY approve rental to groups at the time of reservation and at our sole discretion with a significant additional damage deposit, but you must disclose at the time of reservation that you are a non-family group.

Absolutely no house parties, overcrowding events, or kegs!

Properties are stocked according to their maximum occupancy. Requests for extra items such as towels, sheets, blankets etc. will incur an additional fee to include delivery of items.

QUIET TIME

Many of our properties are in residential areas and we ask you to respect our neighbors by complying with the noise curfew is from 10PM to 8 AM.

GOOD NEIGHBOR AND EVICTION POLICY

Guests shall respect and not interfere with the rights, comfort or convenience of adjacent homeowners or occupants. If Guests violate any of the terms of this agreement, an agent representing Abide Property Management may, at his or her sole discretion, evict Guests and occupants of the property with no refund, which will also include, if applicable, Guest’s security deposit. Please be aware that occupants of adjacent properties have the right to call local law enforcement to enforce quiet hours or to break up parties.

If evicted, Guest’s credit card will be charged a $500 eviction fee. Abide Property Management reserves the right to refuse service to anyone.

The property is leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation.

ASSIGNMENT OR SUBLET

In no event shall a Guest assign or sublet the Rental Property in whole, or in part. This means that The Guest must be present as a guest onsite from the check-in date through the check-out date. The Guest understands that Abide Property Management has the right to send a representative to The Property, to confirm the physical presence of The Guest, on site during the stay.

Adults renting the property for the use of guests under 26 years of age without being onsite during the duration of the stay is strictly prohibited and will result in a $3,000 penalty.

SECURITY CAMERAS

Some of our properties have external security cameras. These security cameras record both video and audio day and night. They are hardwired and have no on/off switch. Guest, agrees not to tamper with, or allow any other guests to tamper with the security cameras, including, but not limited to : covering the camera lens, pointing the camera in a different direction, or doing any other activity that might reasonably interfere with the cameras power or function.

For your privacy, Abide Property Managementhas not installed any cameras within the home's interior. None of the exterior cameras can see into any of the windows of the home or neighbor's homes.

NOISE AND AIR QUALITY MONITORING

Some of Abide Property Management's homes have privacy and hospitality industry approved noise and occupancy monitoring devices. These devices detect sound decibels, but do not record audio. The air quality monitoring detects smoke in parts per million and can differentiate between cigarette smoke, marijuana smoke, and cooking smoke.

SECURITY DEPOSIT & DAMAGE WAIVER

To prevent cases of credit card and identity fraud, we have partnered with a company named Superhog to provide guest screening. Through the Superhog screening process, guests will be offered the option to either purchase an accidental damage waiver, or provide a credit card number for a $500 refundable security deposit. The deposit shall be refunded within 14 days of the check-out date provided no deductions are made due to damages or missing items as explained in the following section. Any damages exceeding the security deposit will be paid by the Guest, and any litigation, if necessary, will be handled in the county where the property is located.

DAMAGES AND MISSING ITEMS

Guest, agrees to assume full responsibility for any items damaged due to misuse or negligence and for any items found to be missing.

If damages occur during your stay, you agree to notify Abide Property Management as quickly as possible.

Guests who have elected to purchase a damage waiver through Superhog will have coverage for accidental damages up to $500.

Guests who have chosen to use a security deposit instead of a damage waiver will be financially responsible for damages to the property. Guest authorizes Abide Property Management to charge the Guest’s credit card in the event of the following:

-Damage to the home or theft of its contents.

-Unauthorized pets: The Guest will be charged for any associated expenses including, but not limited to: carpet cleaning, flea infestation treatment, deep cleaning of the home and furniture to remove all pet hair, etc. The minimum fee for undisclosed pets is $500 per pet per stay, with additional charges as needed to remedy any damages.

-Extensive cleaning required at check out for things including, but not limited to: moving furniture and mattresses back to their correct locations, vomit, human waste, blood or other body fluids, spoiled food, excess garbage, etc.

-Smoking: The Guest will be charged for remedies including, but not limited to: painting, the cleaning fees associated with soft surfaces such as carpets and upholstery, the expense of an ozone or air filtration system, etc. The minimum charge for smoking in the home is $500, with additional charges as needed to remedy damages.

-Exceeding occupancy or parking limits. There is a fee of $100 per person for each guest beyond what has been indicated on the rental agreement.

-Any other mentioned charges/policies in this Rental Agreement.

Guest will be notified of any damage and the costs of remediation (repairs) in writing.

FEES FOR RELOCATION OF INCOMING GUEST

Excessive damage may result in Guest, being charged for the relocation or compensation to the incoming guest if check-in is delayed as a result of damages from the guest's stay.

PET POLICY

Some of Abide Property Management's properties are pet friendly. The terms for pet friendly homes are as follows:

Up to 2 (two) pets are allowed at the property per stay.  There is a $120 pet fee per stay to cover deep cleaning after check-out.  ALL PETS MUST BE DISCLOSED PRIOR TO CHECK-IN. UNDISCLOSED PETS WILL BE SUBJECT TO AN INCREASED PET FEE OF $400 PER PET.  

NON-SMOKING/NON-VAPING POLICY

Abide Property Management's homes are strictly non-smoking. Smoking or vaping of any kind is strictly prohibited. This includes, but is not limited to cigarettes, cigars, pipes, vaping devices, e-cigarettes and drugs of any kind. Smoking in The Property is a serious breach of contract and will result in additional charges and possible eviction. There will be a minimum $500 charge per occurrence to Guest if evidence of smoking (including odor) is discovered. The process of eliminating smoke odor (ozonation, cleaning of furniture, drapes, bedding etc..) can become very costly. If you smoke, you will be charged.

NO GLITTER/ NO DYE/ NO TANNING LOTION POLICY

Glitter is almost impossible to remove and will result in a $800 fine to cover excess cleaning. Use of any temporary or permanent hair dye, sunless tanning lotions, or other dye products in the rental is not allowed. Evidence of dye will result in a $500 fine or more if damage occurs to sink, floors, carpets, etc. The primary contact is responsible for all guests and anyone who enters the home during the stay to abide by these rules.

ITEMS LEFT BEHIND

Should you leave anything behind, we will be happy to mail it to you at your expense with a service charge of $45 per hour for the time to retrieve the item and mail it. You will need to supply your shipping address and a preferred method of payment to cover the shipping costs.

ILLEGAL SUBSTANCES AND UNDERAGE DRINKING

No illegal substances are permitted on the property at any time. Underage drinking is strictly prohibited and may result in eviction without refund. Note, although marijuana is legal in some states, it is illegal here and is not allowed at The Property.

INABILITY TO DELIVER PROPERTY

In the event that Abide Property Management is unable to deliver the Property to the Guest because of fire, eminent domain, act of nature, or delay in construction, the Guest hereby agrees that Abide Property Management and Owner’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by Guest. If at the time Guest is to begin occupancy of the Property, Abide Property Management cannot provide the Property in a fit and habitable condition or substitute a reasonable comparable property in such condition, Abide Property Management shall refund to Guest all payments made by Guest.

Abide Property Management reserves the right to substitute comparable accommodations if circumstances require and a comparable property is available to Abide Property Management to deliver. Pursuant to the terms of this Agreement, Guest expressly acknowledges that in no event shall Abide Property Management or Owner be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving or travel; for any damage, destruction, or loss; or emotional distress or suffering of The Guest or members of The Guest's party related to inability to deliver the property .

USE OF PROPERTY

Guest shall keep the Property as clean and as safe as the conditions of the Property permit, causing no unsafe or unsanitary conditions. Guest agrees not to use the Property or permit the Property to be used for any illegal or unlawful activity or purpose.

FURNISHINGS

Transfer of furnishings of any kind from one property to another or the rearranging of furniture in or on the Property causes substantial extra work for our cleaning teams when preparing the home for the next guests. Therefore, moving mattresses and rearranging furniture is strictly prohibited and will incur additional charges. Upon departure, guests are expected to leave property and contents in their original conditions and positions.

Note - This restriction also applies to patio furniture.

APPLIANCES/EQUIPMENT

Abide Property Management makes every effort to ensure all appliances and equipment are in working order. If you experience a problem, please get in touch with us immediately via the messaging service on the booking platform you used to secure the reservation.

There are no rebates or refunds issued to guests for issues with appliances and equipment as every good faith effort is made to ensure the Property is maintained to the highest standards. Refer to the property listing for information on items included with the Property.

TV, CABLE OR INTERNET

Please be aware that internet and cable are third-party providers contracted through the owner. Due to the geographic location, the internet connection can be intermittent and spotty. If you absolutely must rely on the internet during your vacation, we advise you to have a backup plan, such as a mobile hotspot. Abide Property Management is not responsible for any internet or cable outages.

LINENS/TOWELS

-Blankets and pillows are individually owned and furnished by the homeowners. Additional blankets, pillows, etc. are available upon request for a fee. Damaged or missing items will be charged to The Guest. No contents of the Property, including linens, blankets or towels, shall be taken out of the home.

-The Guest agrees to bring sufficient beach towels for his/her guests to use outside the home

-The Agent stocks and inventories all linens prior to guest arrival and upon departure. Should linens be missing or damaged, Guest’s credit card will be billed a minimum of $75 per missing or damaged piece.

LOCKED AREAS

Areas for which the Guest is not provided a key or lock combination, such as Owner’s personal storage areas, are exempt from this Agreement and are off limits to the Guest. Forced entry into these locked areas is cause for immediate eviction and Guest will be charged for damage and/or missing items as well as a $500 eviction fee.

GARBAGE REMOVAL

It is the Guest’s responsibility to take the garbage cans to the curb on designated days. Signage in each home will indicate which day the trash cans need to be taken to the curb.

Also, please place all garbage in outside collection bins and roll the bins to the curb upon departure.

ENTRY TO PROPERTY

Guest agrees that Agent, Owner or their respective representatives may enter the Property during reasonable hours to inspect the Property, and to make such repairs, alterations, or improvements thereto, as Abide Property Management or Owner may deem appropriate.

INDEMNIFICATION

The Guest agrees to indemnify and hold harmless Abide Property Management and Owner for any damages to or loss from the Property, grounds, furnishings, appliances, household items and any other of the Owner’s property resulting during the Guest’s rental term, normal wear and tear excluded.

The Guest further agrees to indemnify and hold the owner and the rental agent (Abide Property Management LLC) harmless from any claim or liability for any loss or damage whatsoever arising from, related to, or in connection with the rental of The Property, including but not limited to, any claim for personal injury, or damage, or loss of property which is made, incurred or sustained by the Guest or other occupants or invitees of Guest. Neither the owner nor the agent is responsible for any of the Guest’s or other occupant(s) valuables, cash or other property during the rental term or thereafter left at the rental house.

RELEASE OF LIABILITY

Neither Abide Property Management nor Owner will be responsible for accidents or injury to the Guest, any members of its party or any invitees to the Property or for the loss of money or valuables. The Guest, is expressly responsible for the safety of itself and any members of its party and any invitees to the Property and during use of any and all items supplied to the guest by the Abide Property Management or Owner including but not limited to, paddle boards, skim boards, boogies boards, etc, and in so using or permitting to be used the and the recreational or other facilities associated with or a part of the Property, specifically waive any and all liability claim, expressed or implied, against Abide Property Management, Owner, and the Abide Property Management's representatives.
